City Council: AN ORDINANCE AMENDING ORDINANCE NO. 10, ADOPTED BY THE CITY COUNCIL ON MAY 13, 2026, ENTITLED "AN ORDINANCE AUTHORIZING A PARTNERSHIP WITH OPTIMUM FOR THE CITY OF MOUNT VERNON EMPLOYEE APPRECIATION DAY EVENT" The City of Mount Vernon, in City Council convened, does hereby ordain, and enact: Whereas, by correspondence received from the Commissioner of the Department of Recreation, requested authorization to amend Ordinance No. 10, adopted by the City Council on May 13, 2026, authorizing a partnership with Optimum for the City of Mount Vernon Employee Appreciation Day Event on Thursday, May 28, 2026, and on the fourth Saturday in May annually thereafter; and Whereas, the first decretal paragraph of Ordinance No. 10 is hereby amended to reflect a change in venue for the Employee Appreciation Day Event from the steps of City Hall to the Memorial Room in order to promote greater interaction and engagement among City employees in a setting reserved exclusively for City staff and not open to the general public; and Whereas, all other logistics and terms of the event shall remain unchanged, and Optimum will continue to provide a full on-site branded activity at no cost to the City; and Whereas, the partnership with Optimum continues to present a range of direct and indirect benefits to City employees in connection with the Employee Appreciation Day Event; and Whereas, in correspondence dated May 6, 2026, the Deputy Commissioner of the Department of Recreation formally requested authorization for the Department to enter into a partnership with Optimum for the purpose of hosting an Employee Appreciation Day event on [May 18,] Thursday, May 28, 2026; and Whereas, the City of Mount Vernon recognizes the dedication, service, and contributions of its employees to the effective operation of municipal government and the well-being of the community; and Whereas, the Department of Recreation has proposed hosting an Employee Appreciation Day event on [Monday, May 18,] Thursday, May 28, 2026, at City Hall Plaza to honor City employees; and Whereas, Optimum, a connectivity service provider, has offered to partner with the City by providing a full on-site branded activation at no cost to the City of Mount Vernon; and Whereas, said activation will include a branded tent experience, an Optimum sprinter van, and interactive engagement stations designed to enhance the event experience for City employees; and Whereas, the proposed partnership presents both direct and indirect benefits to City employees, including engagement opportunities, morale enhancement, and recognition of public service; and Whereas, the use of City Hall Plaza for such an event serves a valid public purpose by fostering employee appreciation and organizational morale; and Whereas, the City Council finds it to be in the best interest of the City to authorize this partnership and event; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MOUNT VERNON, NEW YORK, AS FOLLOWS: Section 1. Authorization of Partnership. The City Council hereby approves and authorizes the Department of Recreation to enter into a partnership with Optimum for the purpose of hosting an Employee Appreciation Day event on [May 18,] Thursday, May 28, 2026. Section 2. Event Approval and Location. The City Council hereby authorizes the use of City Hall Plaza for the Employee Appreciation Day event on [Monday, May 18,] Thursday, May 28, 2026, for the duration necessary to conduct event activities. Section 3. Event Coordination. The Department of Recreation is hereby authorized to coordinate all logistical, operational, and administrative aspects of the event in collaboration with Optimum, including but not limited to setup, programming, and site management. Section 4. No Cost to the City. The partnership and associated activation provided by Optimum shall be at no cost to the City of Mount Vernon, and no City funds shall be expended unless otherwise authorized by separate resolution of the City Council. Section 5. Compliance with Laws. All activities conducted pursuant to this Ordinance shall comply with applicable federal, state, and local laws, rules, and regulations, including any required permits or approvals. Section 6. Severability. If any clause, sentence, paragraph, or section of this Ordinance shall be adjudged by any court of competent jurisdiction to be invalid, such judgment shall not affect, impair, or invalidate the remainder thereof.
