CITY of ALBUQUERQUE NINETEENTH COUNCIL COUNCIL BILL NO. R-11-281 ENACTMENT NO. ________________________ SPONSORED BY: Debbie O'Malley RESOLUTION t Providing An Appropriation To The Cultural Services Department From Settlement Money Paid To The City By Philips Semiconductor For An Agreement With Explora Science Center And Children's Museum, Inc. And An Appropriation To The Department Of Family And Community Services For An Anti-Heroin Initiative (O'Malley) b PROVIDING AN APPROPRIATION TO THE CULTURAL SERVICES DEPARTMENT FROM SETTLEMENT MONEY PAID TO THE CITY BY PHILIPS SEMICONDUCTOR FOR AN AGREEMENT WITH EXPLORA SCIENCE CENTER AND CHILDREN'S MUSEUM, INC., AND AN APPROPRIATION TO THE DEPARTMENT OF FAMILY AND COMMUNITY SERVICES FOR AN ANTI-HEROIN INITIATIVE. WHEREAS, F/S O-39, Enactment No O-2000-037, authorized the sale of New Mexico Industrial Revenue Bonds (IRB) for Philips Semiconductor (Philips); and WHEREAS, the Ordinance included a contingency provision that Philips would contribute $200,000 annually to the City to develop an educational program for at-risk youth to a total of $2.2 million subject to approval and appropriation by the City Council; and WHEREAS, Philips found it necessary to terminate the IRB and entered into a Mutual Release and Settlement Agreement with the City on September 2, 2003 and made all necessary repayments of Ordinance F/S O-39 (hereafter referred to as the “Clawback Provisions”); and WHEREAS, there is an estimated balance of $1,200,000 in the Philips Clawback Fund held in the Trust and Agency Fund 820; and WHEREAS, Explora Science Center and Children's Museum (Explora) is renown for its interactive exhibits designed specifically for youth; and WHEREAS, Explora provides educational opportunities for children through its classroom programs; and WHEREAS, Explora will be hosting the Association of Science-Technology 2013 Conference; and WHEREAS, the Working Group on Heroin and Opioids seeks to address issues that affect at-risk youth and have lead to tragic outcomes for a number of Albuquerque families whose children have suffered or died from opioid and heroin addictions; and WHEREAS, the working group is made up of parents of youth who have experienced opioid addiction, professionals who work with addicted young people as well as members of the Department of Family and Community Services Health and Human Services Division that funds behavioral health services and substance abuse treatment programs; and WHEREAS, the working group will create a general awareness campaign about the use of heroin and misuse of prescription drugs targeted at various audiences including students, teachers, parents, coaches, pharmacists, dentists and doctors; and WHEREAS, the funding will also be used to address the longer term goal of creating better local treatment options. BE IT RESOLVED BY THE COUNCIL, THE GOVERNING BODY OF THE CITY OF ALBUQUERQUE: Section 1. That funds in the amount of Twenty Five Thousand Five Hundred Eight Dollars ($25,508) from the Philips Clawback Fund in the Trust and Agency Fund (820) are hereby appropriated to the Cultural Services Department in the Operating Grants Fund 265 for the purposes of funding Explora Science Center and Children's Museum for its educational programs. Of that amount, five hundred eight dollars ($508) is for indirect costs. Section 2. That funds in the amount of One Hundred Two Thousand Dollars ($102,000) from the Philips Clawback Fund in the Trust and Agency Fund (820) are hereby appropriated to the Department of Family and Community Services in the General Fund 110 for the purposes of funding an Anti-Heroin Initiative. Of that amount, two thousand dollars ($2,000) is for indirect costs and ten thousand dollars ($10,000) is to be used by the Heroin Awareness Committee for the production of an educational video and other educational materials. Section 3. The Mayor is authorized to enter into an agreement with Explora Science Center and Children's Museum to carry out the purposes of this Resolution. Section 4. The Mayor is authorized to enter into an agreement to carry out the purposes of this Resolution for the Anti-Heroin Initiative. Section 5. The Department of Family and Community Services shall provide a report to the Mayor and City Council six months after adoption of this Resolution. The report shall include but not be limited to a narrative describing the activities undertaken by the Department of Family and Community Services in collaboration with the Working Group on Heroin and Opioids and the Heroin Awareness Committee.
