cover TO: Mayor John Laesch FROM: Steve Andras, P.E., Airport Manager DATE: 4-22-26 SUBJECT: This request is for authorization for the Mayor to enter into an Agency Agreement with the State of Illinois Department of Transportation Division of Aeronautics for the acceptance of Aviation Fuel Tax collected for the City of Aurora. PURPOSE: To enter into an Agency Agreement with the State of Illinois to recover aviation fuel sales tax that has been collected. BACKGROUND: The State of Illinois collects tax revenue from aviation fuel sales to reimburse capital and operational costs for public-use airports. Funding fluctuates from year to year based on tax revenue collected and is allocated to Illinois airports by mandated formula. Aviation fuel tax (AFT) can only be used for reimbursement of capital or operation expenditures. Aviation fuel tax due the Aurora Municipal Airport is currently $803,079.96. DISCUSSION: Reimbursement for AFT funds is administered through the IDOT Division of Aeronautics by way of state grant process requiring an agency agreement, like that of our typical projects. IMPACT STATEMENT: The approval of this resolution will have no negative impact. Rather, it will allow the City of Aurora to recover operational expenses reducing subsidy of the airport. RECOMMENDATIONS: The airport staff recommends the approval of this resolution. cc: Building, Zoning and Economic Development Committee CITY OF AURORA, ILLINOIS RESOLUTION NO. _________ DATE OF PASSAGE ________________ title A Resolution authorizing the Mayor to enter into an Agency Agreement between the City of Aurora, IL and the State of Illinois Division of Aeronautics for the purpose of receiving Aviation Fuel Tax funds for the reimbursement of capital or operational expenses at the Aurora Municipal Airport. body WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and WHEREAS, the City of Aurora owns operates and maintains the Aurora Municipal Airport; and WHEREAS, the State of Illinois collects Aviation Fuel Tax (AFT) based on fuel sales in the state; and WHEREAS, public-use airports in Illinois are appropriated AFT funds based on a mandated formula; and WHEREAS, the State of Illinois Division of Aeronautics distributes AFT funds through the State grant process requiring and Agency Agreement. WHEREAS, the City of Aurora desires to authorize the Mayor to sign any Agency Agreement pertaining to the City's receipt of AFT funds. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: that the Mayor is hereby authorized to enter into an Agency Agreement between the City of Aurora, IL and the State of Illinois Division of Aeronautics for the purpose of receiving Aviation Fuel Tax funds for the reimbursement of capital or operational expenses at the Aurora Municipal Airport.
