BACKGROUND:
In 2005, the City of Edgewater approved the River Oaks Condominium project. In the general election in 2006, the voters of the City of Edgewater placed a charter amendment to restrict the height of residential development to 35 feet tall east of US 1. Fast forward to the last three years, the River Oaks Condominiums PUD was replaced by the City Council with the Edgewater River Oaks MUPUD in 2023. The River Oaks Condominium was entitled for 308 residential dwelling units with a maximum allowable height of 190 feet with a 27 foot setback from Jones Fish Camp Road, with access served only from US 1. The Edgewater River Oaks project replaced the condominiums for 196 unit two-story typology apartments, a marina, 60 foot tall hotel, a restaurant, and 55 foot tall dry stack boat storage facility. Access for the apartments in Edgewater River Oaks is served from both US 1 and Jones Fish Camp Road. The marina, hotel, dry stack boat storage, and restaurant only has access from Jones Fish Camp Road.
City staff supported and still support our recommendation and the project as depicted to the Planning and Zoning Board and the City Council for the following reasons:
1. The City Charter was amended by the voters to restrict residential height to 35 feet east of US 1 because of the River Oaks Condo approval. - Righting a wrong.
2. Edgewater River Oaks MUPUD reduces residential by 127 units and adds 150,000 square feet of commercial. (More Tax Revenue - Diversifying Activity, Comp Plan: Encouraging Water Front Development, Mixed Use Development, Conservation Overlay)
3. It meets a higher stormwater standard, 100 year versus the 25 year and meets higher water quality standards for nitrogen and phosphorus removal.
4. Provides apartments in a style the community desires (less than 35' in height) - City has less than 40 apartments in the entire city.
5. Rebuilds Jones Fish Camp Road which did not receive the necessary upgrades as a part of the Riverfront Estates Development.
6. Creates a traffic light enabling better access for new and existing residents.
In November of 2024, the Council recodified the Development Agreement for Edgewater River Oaks MUPUD with the inclusion of the remaining parcel located on the River. During this hearing, the City Council requested that the road agreement be prepared and received prior to voting on any major site plan. The Council also requested that the developer hold a community meeting with the Riverfront Estates Community to ascertain their input on the design of Jones Fish Camp Road. The Council also requested that those design features be included in the cost. Also at this hearing, the City Council approved the major site plan for the 196 apartments. As a part of this approval, the City Council also approved the Edgewater River Oaks Transportation Impact Analysis (TIA) with the Proportionate Share Agreement for the entire Edgewater River Oaks MUPUD. The Edgewater River Oaks TIA outlined according to FDOT cost standards that the reconstruction of Jones Fish Camp Road would cost $3,776,311.29. The TIA identified that the City's portion was $512,375.89 and the Developer's portions accumulated to $3,263,935.4
SUMMARY:
The Developer met with the Riverfront Estates subdivision community and received input on the design features. Concerns regarding traffic safety, multi-modal transportation options, and aesthetics were discussed. City staff used these concerns to help design the roadway before the Council today. The design elements include a bicycle lane, an entry way median, two (2) pavered and landscaped roundabouts. City staff included in the design features street lights to match the Riverfront Estates Subdivision. In addition to the design features, through a roadway analysis, it was determined that Jones Fish Camp Road has substandard stormwater drainage and capacity for both water attenuation and treatment. The roadway design and cost before the Council today has the developer providing for better conveyance of stormwater and the developer has dedicated a portion of the property for a stormwater pond.
The Public Private Partnership Roadway Agreement allows the Developer to build Jones Fish Camp Road in lieu of the City constructing the road. This agreement allows for the Developer to hire a contractor to perform said work with the City providing reimbursement. In addition, the agreement provides for interim repairs of Jones Fish Camp Road at no expense to the City of Edgewater by the Developer. The agreement also outlines the that Jones Fish Camp Road must be completed within five (5) years of the date of the agreement.
The Developer has provided two cost estimations from their contractor for Jones Fish Camp Road. The first cost estimation is to build a brand new generic road, which totaled $1,730,858.79. The second estimation inclusive of the design features is $3,776,311.63 (agreement amount). Recall, the original FDOT construction cost identified in the Edgewater River Oaks TIA for a basic reconstruction of Jones Fish Camp Road was $3,776,311.29.
The total cost to the City as described within the Roadway Agreement is $1,888,155,82. This represents an increase of $1,375,779.93 over the background traffic costs associated with the Edgewater River Oaks TIA. The cost of $1,375,779.93 is if the City decided to build a basic road still through a Roadway Agreement.
City staff have identified sufficient funds within the multi-modal transportation impact fee to support the proposed Roadway Agreement. City staff believe the agreement before the Council reflects the Councils desire to have the adjacent subdivisions input and to have an aesthetically designed roadway.
